There are three types of applications: Intent-to-Use, Standard, and Plus.
Intent-to-Use
An intent-to-use application allows you to reserve a name for 6 months. An additional Statement of Use form must be filed when the business starts using the term in commerce. There are 6 month extensions available for up to a total of 3 years. The benefit of this form of application is a priority date.
1) Applicant’s domicile and citizenship 2) Description of the goods that the applicant has a bona fide intention to use the mark 3) Drawing of the mark
Standard
To obtain a trademark or service mark, you will need to file a full application. An Intent-to-Use is just a reservation.
1) Applicant’s name, domicile, citizenship and whether a corporation/partnership 2) Name and address for correspondence 3) Clear drawing of the mark and supplemental information 4) Filing fee 5) Description of the goods for which the mark is used 6) Identification of the term (i.e. classification) 7) Verified Statement 8) Date of applicant’s first use of the mark 9) Date of the applicant’s first use of the mark in commerce 10) Specimen(s)
Plus
The Plus application requires more information and has a lower application fee. However, everything must be filed electronically and communication is by e-mail.
1) Applicant’s Name and Address 2) Applicant’s Legal Entity 3) Citizenship of applicant, or state/country of incorporation of a company 4) If a partnership, the names and citizenship of the general partners 5) Name and address for correspondence 6) E-mail address and authorization for the Trademark Office to use 7) One or more bases of registrations 8) Correctly classified goods/services 9) Filing Fee 10) Verified Statement 11) Clear Drawing of the Mark and corresponding data 12) Written Consent and Name of Individual if name/portrait/likeness is used as mark 13) Claim of ownership in registrations if applicant owns multiple filings on same mark 14) Additional information if a concurrent registration |
